General Terms and Conditions for Travelers
These General Terms and Conditions (“GTC”) govern the contractual relationship between LocalLike GmbH, registered in the commercial register of the Hamburg District Court under HRB 185594 (“LocalLike”), and the users (Travelers) who use LocalLike’s services, and also define the conditions under which the services of LocalLike can be used.
By registering on the LocalLike platform, for example locallike.de (“Website”) as well as in the mobile apps for iOS and Android devices (“LocalLike App”) (collectively also referred to as “LocalLike Platforms”), the Traveler agrees to the following provisions. If the Traveler does not agree with the provisions, they must refrain from registering.
The masculine form used refers to all female, male, and other gender identities equally.

Scope of Application
These GTC apply to the use of LocalLike’s platform and thus also include the mobile apps of LocalLike GmbH as well as all websites of LocalLike GmbH that refer to these GTC. Deviating regulations or additions, in particular any conditions of the Traveler that contradict these GTC, require the express written consent of LocalLike.
About LocalLike
Platform/License/LocalLike App
Platform/Service
LocalLike provides a platform for third parties to offer services (“Activities”) for a financial compensation (“Local”) or to book such services from a third party (“Traveler”). Payment is made directly from the Traveler to the Local.
LocalLike does not offer any own activities or services beyond providing the LocalLike platforms.
License
Subject to compliance with the terms of this agreement (including the GTC along with the Community Guidelines), the Traveler is hereby granted a non-exclusive, limited, revocable, non-transferable, non-sublicensable license to use the platform and, in particular, to download, install, and use the LocalLike App on a mobile device, provided that the installation and use of the LocalLike App is exclusively (i) for personal use and non-commercial purposes and (ii) in accordance with the restrictions and limits set forth in this agreement. The LocalLike App may not be copied, transferred, rented, lent, modified, adapted, nor may the Traveler create derivative works, redistribute or sublicense it. In particular, a Traveler may not copy, download, redesign, use, reconfigure, reverse engineer, transmit to third parties or use the platform or parts thereof or thereon, in whole or in part, without prior written consent from LocalLike. All rights not expressly granted to you under this agreement are reserved by us or any third-party licensors.
LocalLike App
If the Traveler accesses or downloads an app from the Apple App Store, they agree to the Apple Licensed Application End User License Agreement and will comply with it in accessing and using the app(s). If the Traveler accesses or downloads an app from the Google Play Store, they agree to the Google Play Terms of Service and will comply with them in accessing and using the app(s).
Role of LocalLike
LocalLike acts exclusively as a platform operator or app provider and assumes no further role. In particular, no third-party services (activities) are offered by LocalLike itself.
Conclusion of the Contract / Creating the Travel Profile
The contract between LocalLike and the Traveler is concluded by creating a travel profile (“Registration”) and is concluded for an indefinite period.
The usage contract is not transferable to third parties.
The Traveler can register for free by filling out the registration form. The Traveler can also register via the connect functions of third-party providers (e.g., Facebook / Google). In this process, selected data from the respective user profiles are stored in the LocalLike database. By registering through the connect functions, the Traveler agrees to the respective terms of the third-party provider and consents to the storage of certain data in the LocalLike database.
Together with the username, the Traveler chooses a secure password. The Traveler should take all necessary measures to protect the password from unauthorized use.
LocalLike reserves the right to refuse registration of Travelers for factual reasons. These are in particular the following reasons: violation of the GTC, fraud prevention measures, doubts about identity, suspicion of spam, doubts about age, deception, registration in markets where LocalLike is not available. LocalLike may make registration dependent on additional steps, such as an identification process or measures to prevent spam.
Only one user account can be created for each Traveler. Existing user accounts must be deleted before a new user account can be registered. Multiple registrations and repeated registrations are prohibited for Travelers banned by LocalLike.
Use is only permitted for natural persons who have reached the age of 18. If the age of majority at the place of residence or usual abode of the user occurs at a later date, this age shall apply accordingly.
Use is not permitted for sex offenders. These are individuals who are registered as “Sex Offenders” in the USA or who have been convicted of sexual offenses (§§ 174 to 180 or § 182 StGB or §§ 180 a, 181 a, 183 to 184 g StGB) or under relevant criminal provisions (§§ 171, 225, 232 to 233 a, 234, 235 or 236 StGB) or corresponding regional regulations for the protection of children and young people.
No criminal background checks are carried out.
Services of LocalLike
Searching for Locals
The Traveler can filter the activities advertised by the Locals within the radius they have specified according to their preferences. By swiping, the Traveler can see the individual activities and view the description of the activity or the profile of the Local itself by clicking.
Booking an Activity
If the Traveler finds an activity they wish to book, they select an available time at which they wish to book the activity offered by the Local. After sending the booking request, it is received by the Local, who may accept or decline the booking request. Sending the booking request does not result in an automatic acceptance of the request. After the booking request is delivered to the Local, the Traveler receives an acceptance or rejection of their booking request. If the Traveler receives an acceptance of the booking request from the Local, the Local sends the Traveler further details about the execution of the activity. After the acceptance of the booking request, the Traveler and the Local have the opportunity to communicate with each other via chat.
Canceling an Activity
In some cases, it is not possible to cancel a booking request for activities after it has been accepted by the Local. For certain activities, the Locals or LocalLike may allow a request to be canceled. In these cases, the Traveler may be charged the cancellation fee displayed prior to cancellation.
Security / Updates
The Traveler agrees to download updates.
Costs and Payments in the Test Version
Costs for App/Web Services
The LocalLike platform is currently a test version, the use of which is currently free of charge. However, LocalLike reserves the right to introduce a usage fee, in which case the Traveler will be informed in text form and will have the opportunity to terminate the contractual relationship before such a fee is introduced. If the Traveler chooses to terminate, they will no longer have access to the app/web services and will not be able to use them.
LocalLike reserves the right to introduce a fee for certain elements on the LocalLike platforms. This will be the subject of separate regulations.
Costs for Activities (Third-Party Services)
When the Traveler submits a booking request via the LocalLike App or website, they agree to pay the displayed costs and are responsible for all costs or fees associated with the booked activity related to their account. LocalLike reserves the right to charge a fee for each activity booked through LocalLike in the future, in which case the Traveler will be informed in text form and will have the opportunity to terminate the contractual relationship before such a fee is introduced. If termination is chosen, the Traveler will no longer have access to LocalLike services and will not be able to use them.
In cases where activities cannot be provided due to actions or omissions attributable to the Traveler (e.g., if the Traveler is not present at the agreed time and place to conduct the activity), the costs due for the booked activity must be paid in full. LocalLike or the Local will credit any saved expenses.
General
Prices may be changed on the platform from time to time with effect for the future.
Costs do not include tips. Travelers may give tips personally.
In the test version of the platform, LocalLike does not charge fees for the mediation of activities. Payment for the booked activities through the LocalLike platform is not possible in the test version. Payment for the booked activity is arranged directly between the Local and the Traveler.
Unless otherwise agreed, all costs are due immediately after acceptance of a booking request, with LocalLike not monitoring or being responsible for the payment process. The Traveler agrees that invoices will only be made available in electronic form.
Costs and fees include any applicable taxes, including VAT.
Termination of the Travel Profile
Deletion by the Traveler
The Traveler may terminate their travel profile at any time without notice.
The Traveler can terminate their travel profile by ceasing to use the travel profile and deactivating it. There is a corresponding option “Deactivate account” in the account settings on the platform.
Consequence of Deletion
Upon deletion of the travel profile, all stored data will be permanently deleted, unless there is an obligation to retain it.
Termination by LocalLike
LocalLike may terminate the travel profile with two weeks’ notice. LocalLike’s right to terminate the travel profile without notice for good cause, e.g., in the event of serious or repeated violations of the terms of use, remains unaffected.
LocalLike may terminate a travel profile by giving notice in text or written form.
All data relating to a travel profile will be automatically deleted.
LocalLike may delete a travel profile without notice in the event of a violation of any part of these GTC or the Community Guidelines.
LocalLike may delete a travel profile without notice if the Traveler does not make use of their travel profile within six months.
LocalLike may delete a travel profile immediately if the travel profile was created using false information. This applies in particular to the following information: first and last name, date of birth, gender, or residential address.
In the event of termination by LocalLike for good cause, the Traveler may not create a new travel profile or use the travel profile of other users.
Data Protection
The Traveler agrees to the storage and use of their personal data by LocalLike for purposes related to the provision and use of the platform. LocalLike will use and store the Traveler’s personal data in accordance with its Privacy Policy, which can be viewed at any time at locallike.de/datenschutz.
Liability and Disclaimer
Liability of LocalLike
LocalLike is only liable for intent and gross negligence. For simple negligence, LocalLike is only liable in the case of breach of a material contractual obligation (obligations whose fulfillment enables the proper execution of the contract in the first place and on whose compliance the contracting party regularly relies and may rely), and in the case of injury to life, body, or health.
In the case of simple negligence, the liability of LocalLike is limited to the typical foreseeable damage. LocalLike’s liability is excluded to the extent permitted by law for slight negligence.
Liability of the Traveler
The Traveler is liable for damages caused by them through the use of LocalLike platforms or in connection with a booked activity in accordance with the statutory provisions.
Indemnification
The Traveler agrees to indemnify and hold LocalLike harmless from any and all claims, damages, expenses, costs (including reasonable attorneys’ fees), and liabilities resulting from the Traveler’s violation of these GTC or applicable law.
Final Provisions
Changes to the GTC
LocalLike reserves the right to make changes to these GTC at any time. The Traveler will be informed of changes in text form or by e-mail no later than two weeks before the changes take effect. If the Traveler does not agree to the changes, they must cease using the platform and deactivate their account. If the Traveler continues to use the platform after the changes take effect, they agree to the changes.
Severability Clause
If any provision of these GTC is or becomes invalid or unenforceable, the remaining provisions shall remain unaffected. The invalid or unenforceable provision shall be replaced by a valid and enforceable provision that comes closest to the intended economic purpose of the invalid or unenforceable provision.
Applicable Law and Jurisdiction
The contractual relationship between LocalLike and the Traveler is governed by the laws of the Federal Republic of Germany, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG). The exclusive place of jurisdiction for all disputes arising from or in connection with this contractual relationship is Hamburg, Germany, provided that the Traveler is a merchant or has no general place of jurisdiction in Germany.

All rights not expressly granted to you under this agreement are reserved to us or any third-party licensors.
LocalLike App
If the Local accesses or downloads an app through the Apple App Store, they agree to the End User License Agreement for Licensed Applications from Apple and will comply with it when accessing and using the app(s). If the Local accesses or downloads an app through the Google Play Store, they agree to the Google Play Terms of Service and will comply with them when accessing and using the app(s).
Role of LocalLike
LocalLike acts solely as a platform operator or app provider and assumes no further role. In particular, LocalLike does not offer any third-party services (activities) itself.
Conclusion of Contract / Creation of Provider Profile
The contract between LocalLike and the Local is concluded by creating a provider profile (“registration”) and is concluded for an indefinite period.
The user agreement is not transferable to third parties.

These are individuals registered as “Sex Offenders” in the USA or convicted of sexual offenses (§§ 174 to 180 or § 182 of the German Criminal Code or §§ 180a, 181a, 183 to 184g of the German Criminal Code) or under relevant provisions protecting children and young persons, or equivalent regional regulations.

Services of LocalLike
Offering Activities
The Local can advertise one or more activities on their provider profile that they wish to offer to Travelers. The following information is mandatory for listing an activity: description of the activity, price, location, estimated duration.
If offered activities do not meet the minimum content requirements or violate the community guidelines, LocalLike reserves the right to delete the activity and/or the provider profile.
Booking an Activity
If a Traveler finds an activity they wish to book, they select an available time in which they want to book the activity offered by the Local. After submitting the booking request, this request is received by the Local, and acceptance or rejection of the booking request is at the discretion of the Local. Submitting the booking request does not automatically result in acceptance of the request. Once the booking request has been submitted to the Local, the Traveler receives acceptance or rejection of their booking request.
If the Traveler receives acceptance of the booking request from the Local, the Local sends further details about the conduct of the activity to the Traveler. After acceptance of the booking request, the Traveler and Local have the opportunity to communicate with each other via chat. By accepting the booking request, a contract is concluded between the Traveler and Local for which the Local is solely responsible. LocalLike will not be a party to the contractual relationship between the Traveler and the Local. The Local is entitled to regulate the execution of their activities through their own terms and conditions, provided these do not violate applicable law and do not contradict LocalLike’s GTC.
Cancellation of an Activity
In some cases, it is not possible to cancel a booking request for activities after it has been accepted by the Local. For certain activities, Locals or LocalLike may allow a request to be canceled. In these cases, however, the Traveler may be charged the cancellation fee displayed before the cancellation.

Costs and Payments for Trial Version
Costs for App/Website Services
The LocalLike platform is currently in a trial version, and its use is currently free of charge. However, LocalLike reserves the right to introduce a user fee, in which case the Local will be informed in writing, and they will have the opportunity to terminate the contractual relationship before such a fee is introduced. If the Local chooses to terminate, they will no longer have access to the app/website services and will no longer be able to use them.
LocalLike reserves the right to introduce a fee for certain items on the LocalLike platforms. This will be subject to separate regulations.
Costs for Activities (Third-Party Services)
If the Local accepts a booking request via the LocalLike app or website, they agree to bear all costs or fees associated with the booked activity that accrue in connection with their account. The Local is responsible for claiming the costs incurred for the offered activity from the Traveler. LocalLike reserves the right to charge a fee for each activity booked through LocalLike in the future, in which case the Local will be informed in writing, and they will have the opportunity to terminate the contractual relationship before such a fee is introduced. If termination is chosen, the Local will no longer have access to LocalLike services and will no longer be able to use them.
In cases where activities cannot be provided due to actions or omissions attributable to the Traveler (for example, if the Traveler is not present at the agreed time and place to perform the activity), the costs due for the booked activity are payable in full without deduction. LocalLike or the Local will credit any saved expenses.
In cases where activities cannot be provided due to actions or omissions attributable to the Local (for example, if the Local is not present at the agreed time and place to perform the activity), the costs due for the booked activity are to be reimbursed to the Traveler without deduction.
General

During the trial version of the platform, LocalLike does not charge fees for the mediation of activities. Payment for booked activities via the LocalLike platform is not possible in the trial version. The payment for the booked activity is made after consultation between the Local and the Traveler.
Unless otherwise agreed, all costs are due immediately after acceptance of a booking request, with LocalLike not monitoring or responsible for the payment process. The Traveler agrees that invoices will only be made available in electronic form.

Termination of Provider Profile
Deletion by the Local
The Local can terminate their provider profile at any time without observing a notice period.
The Local can terminate their provider profile by discontinuing the use of the profile and deactivating it. They will find a corresponding option “Deactivate Account” in their account

Services of LocalLike

If offered activities do not meet the minimum content or violate the community guidelines, LocalLike reserves the right to delete the activity and/or the provider profile.

If the Traveler finds an activity they want to book, they select an available time when they want to book the activity offered by the Local. After submitting the booking request, this booking request is received by the Local, and the acceptance or rejection of the booking request is up to the Local. Submitting the booking request does not automatically constitute acceptance of the request. After the booking request has been submitted to the Local, the Traveler receives acceptance or rejection of their booking request from the Local.
If the Traveler receives acceptance of the booking request from the Local, the Local sends further details about the conduct of the activity to the Traveler. After acceptance of the booking request, the Traveler and Local have the opportunity to communicate with each other via chat. By accepting the booking request, a contract is concluded between the Traveler and the Local, for whose content the Local is solely responsible. LocalLike does not become a party to the contractual relationship between the Traveler and the Local. The Local is entitled to regulate the execution of their activities through their own terms and conditions, provided they do not violate applicable law and do not conflict with LocalLike’s GTC.
Cancellation of an Activity
In some cases, it may not be possible to cancel a booking request for activities after it has been accepted by the Local. For certain activities, Locals or LocalLike may allow a request to be canceled. However, in these cases, the Traveler may be charged the cancellation fee displayed before the cancellation.

The Local undertakes to download updates.
Costs and Payments during Trial Version
Costs for App/Website Services
The LocalLike platform is currently a trial version, and its use is currently free of charge. However, LocalLike reserves the right to introduce a usage fee, about which the Local will be informed in writing in this case, and they will have the opportunity to terminate the contractual relationship before such a fee is introduced. If the Local chooses to terminate, they will no longer have access to the app/website services and will no longer be able to use them.
LocalLike reserves the right to introduce a fee for certain items on the LocalLike platforms. This will be subject to separate regulations.
Costs for Activities (Third-Party Services)
If the Local accepts a booking request via the LocalLike app or website, they agree to bear all costs or fees associated with the booked activity that are related to their account. The Local is responsible for claiming the costs incurred for the offered activity from the Traveler. LocalLike reserves the right to charge a fee for each activity booked through LocalLike in the future, about which the Local will be informed in writing in this case and will have the opportunity to terminate the contractual relationship before such a fee is introduced. If termination is chosen, the Local will no longer have access to the LocalLike services and will no longer be able to use them.
In cases where activities cannot be provided due to acts or omissions attributable to the Traveler (e.g., if the Traveler is not present at the agreed time and place to conduct the activity), the costs due for the respective booked activity must be paid without deduction. LocalLike or the Local will credit any saved expenses.

General
Prices may be changed for the future on the platform from time to time.
The costs do not include tips. Travelers may give tips personally.
During the trial version of the platform, LocalLike does not charge fees for the mediation of activities. Payment for the booked activities via the LocalLike platform is not possible during the trial version. The payment for the booked activity is made after consultation between the Local and the Traveler.
Unless otherwise agreed, all costs are due immediately upon acceptance of a booking request, with LocalLike not monitoring or being responsible for the payment process. The Traveler agrees that invoices will only be made available in electronic form.
The costs and fees include any applicable taxes, including VAT.
Termination of Provider Profile
Termination by the Local
The Local can terminate their provider profile at any time without observing a notice period. The termination takes effect immediately.
Termination by LocalLike
LocalLike reserves the right to terminate the provider profile of the Local at any time with a notice period of two weeks. The right to terminate for cause remains unaffected. Cause for termination includes, but is not limited to, violation of these GTC, suspicion of fraudulent activities, or other legitimate interests of LocalLike that justify termination.
Consequences of Termination
Upon termination of the provider profile, LocalLike will delete the profile and all associated data, unless LocalLike is legally obligated to retain such data. The Local is responsible for securing their own data before termination.
Liability
LocalLike is not liable for the success of the mediated activities. The contract for the mediated activities is concluded exclusively between the Local and the Traveler. LocalLike is not a party to this contract and does not assume any liability for the activities and services offered by the Local.
LocalLike is not liable for the correctness, completeness, quality, or legality of the activities and services offered by the Locals. LocalLike does not provide any assurances or guarantees regarding the activities and services offered by the Locals.
LocalLike is only liable for damages caused intentionally or through gross negligence by LocalLike, its legal representatives, or vicarious agents. LocalLike is not liable for slight negligence, except in cases of injury to life, body, or health, or the breach of essential contractual obligations. Essential contractual obligations are those whose fulfillment is essential for the proper execution of the contract and on whose compliance the Local can regularly rely. In the event of a breach of essential contractual obligations, LocalLike’s liability is limited to the typically foreseeable damage.
The limitations of liability also apply to indirect damages, in particular loss of profit.
Data Protection
LocalLike collects, processes, and uses personal data of the Locals and Travelers in compliance with the applicable data protection regulations. The details are regulated in the privacy policy, which can be accessed on the LocalLike website.
Changes to the GTC
LocalLike reserves the right to change these GTC at any time with a notice period of four weeks. The changes will be communicated to the Locals in text form (e.g., by email) and will become effective if the Local does not object within four weeks after receipt of the notification. LocalLike will specifically inform the Locals about their right to object and the legal consequences of silence.
If the Local objects to the changes within the specified period, the contractual relationship continues under the previous conditions. In the event of an objection, LocalLike reserves the right to terminate the contractual relationship with the Local with a notice period of two weeks.
Final Provisions
Should individual provisions of these GTC be or become invalid or unenforceable, the validity of the remaining provisions shall not be affected. In place of the invalid or unenforceable provision, a valid and enforceable provision shall be deemed to have been agreed upon which comes closest to the economic intent pursued by the parties.
The law of the Federal Republic of Germany applies to these GTC, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
The exclusive place of jurisdiction for all disputes arising from or in connection with these GTC or with the use of the LocalLike platform is Hamburg, provided that the Local is a merchant, a legal entity under public law, or a special fund under public law or has no general place of jurisdiction in Germany.
Supplementary Agreement
Any supplementary agreements, modifications, or amendments to these GTC must be made in writing to be valid. This also applies to any waiver of the written form requirement.
